1. Agreement to Terms

By accessing or using SmutWriter ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

By creating an account, subscribing to a plan, or using any features of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

Your continued use of the Service constitutes your acceptance of any updates or modifications to these Terms.

2. Eligibility and Age Verification

MANDATORY AGE REQUIREMENT: You must be at least 18 years of age (or the legal age of majority in your jurisdiction, whichever is greater) to use this Service.

By using SmutWriter, you represent and warrant that:

  • You are at least 18 years old and have reached the age of majority in your jurisdiction.
  • You have the legal capacity to enter into a binding agreement.
  • You are not prohibited from using the Service under any applicable laws.
  • You will comply with all local, state, national, and international laws and regulations applicable to your use of the Service.

SmutWriter reserves the right to implement age verification procedures at any time. If we have reason to believe you are under the required age, we will terminate your account immediately without a refund.

3. Service Description

SmutWriter is an AI-powered writing assistant designed for creative fiction writing, including adult and erotic content. The Service provides:

  • AI-assisted story generation and writing
  • An uncensored writing environment without content filters
  • Story management and export features
  • Various subscription tiers with different usage limits

The Service is designed to assist with creative writing and is provided without content restrictions or censorship. Users have full creative freedom and are solely responsible for the content they create.

SmutWriter acts solely as a technology platform that provides access to third-party artificial intelligence models. SmutWriter does not create, author, curate, review, approve, or endorse any content generated through the Service. The AI models are provided by independent third-party providers, and SmutWriter has no control over the specific outputs they produce.

4. Personal Use Only

THE SERVICE IS PROVIDED EXCLUSIVELY FOR PERSONAL, PRIVATE, NON-COMMERCIAL CREATIVE WRITING AND ENTERTAINMENT PURPOSES.

By using the Service, you acknowledge and agree that:

  • All content generated through the Service is intended for your personal, private use only
  • The Service is a creative fiction tool — all AI-generated output is fictional and does not depict, reference, or relate to any real persons, events, or circumstances unless you, as the user, direct it to do so
  • You shall not use the Service to produce content intended for commercial distribution, publication, or sale without assuming all legal responsibility for such content
  • If you choose to publish, distribute, share, or commercially exploit any content created using the Service, you do so entirely at your own risk and assume all legal liability
  • SmutWriter bears no responsibility or liability whatsoever for any content that leaves the confines of the Service, including content you copy, export, screenshot, share, publish, or distribute in any form

5. User Content, Responsibility, and Assumption of Risk

YOU ARE SOLELY AND EXCLUSIVELY RESPONSIBLE FOR ALL CONTENT YOU CREATE, GENERATE, DIRECT, PROMPT, SAVE, SHARE, PUBLISH, OR DISTRIBUTE USING THE SERVICE. YOU ASSUME ALL RISKS AND LEGAL LIABILITY ASSOCIATED WITH SUCH CONTENT.

By using the Service, you acknowledge and agree that:

  • You are the sole author and publisher of any content you create, direct, or generate using the Service, regardless of the degree of AI assistance involved
  • You exercise sole editorial control over all AI-generated output — you choose what prompts to submit, what output to keep, and what content to save or share
  • You assume all risks and liabilities associated with the content you create, including but not limited to legal, civil, criminal, regulatory, reputational, and financial risks
  • SmutWriter does not and cannot review, edit, filter, approve, monitor, or endorse any user-generated or AI-generated content
  • You are solely responsible for ensuring your content complies with all applicable local, state, national, and international laws and regulations in your jurisdiction
  • SmutWriter is not responsible for how you use, publish, distribute, or share your content and bears no liability for any consequences arising from your content
  • The decision to create adult, explicit, or any other type of content is entirely your own voluntary choice, made with full knowledge of the potential legal and personal consequences
  • You voluntarily assume all risk of harm, loss, or damage arising from your use of the Service and the content you create

You retain ownership of all content you create using the Service. SmutWriter claims no ownership rights over your creative works and, correspondingly, assumes no liability for them.

6. AI-Generated Content Disclaimer, Liability, and Copyright

The AI writing assistance provided by SmutWriter is generated by third-party artificial intelligence systems over which SmutWriter exercises no editorial control. You acknowledge and understand that:

  • AI-generated content may be inaccurate, inappropriate, offensive, illegal in certain jurisdictions, or unsuitable for any particular purpose
  • SmutWriter makes no guarantees whatsoever regarding the quality, accuracy, legality, creativity, originality, non-infringement, or suitability of AI-generated content
  • You must review and take full responsibility for all AI-generated output before using, saving, or sharing it — the burden of review rests entirely on you
  • AI responses are generated algorithmically by third-party models and do not represent the views, opinions, intentions, or endorsement of SmutWriter or its operators
  • The AI may produce content that is objectionable, offensive, disturbing, or illegal in your jurisdiction — this is inherent to an uncensored writing tool and you accept this risk
  • AI models are trained on large datasets and may generate output that resembles, is similar to, or is substantially identical to existing copyrighted works, trademarks, or other intellectual property — SmutWriter is not liable for any such similarity or infringement
  • You are solely responsible for determining whether any AI-generated content infringes on third-party intellectual property rights before using, publishing, or distributing it
  • AI-generated content may not be eligible for copyright protection under applicable law, and SmutWriter makes no representation regarding the copyrightability of any output

COMPREHENSIVE LIABILITY DISCLAIMER

SMUTWRITER AND ITS OPERATORS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS (COLLECTIVELY, "SMUTWRITER PARTIES") SHALL NOT BE LIABLE UNDER ANY CIRCUMSTANCES FOR ANY CONTENT GENERATED, CREATED, PROMPTED, DIRECTED, OR PRODUCED THROUGH THE SERVICE, REGARDLESS OF:

  • The nature, subject matter, or legality of such content
  • Whether such content violates any local, state, national, or international law, regulation, or statute
  • Whether such content infringes upon any third-party intellectual property rights, including copyrights, trademarks, patents, or trade secrets
  • Whether such content is defamatory, obscene, harmful, threatening, abusive, or otherwise objectionable
  • Whether such content causes harm, injury, loss, or damage to any person or entity
  • Whether SmutWriter had knowledge of or the ability to prevent the creation of such content

As the user, you have final and exclusive editorial control and are the sole "publisher" of any content you choose to save, retain, or distribute. You agree that SmutWriter is a neutral provider of interactive computer services under 47 U.S.C. § 230 and shall be treated as such under all applicable laws.

YOU EXPRESSLY WAIVE ANY AND ALL CLAIMS AGAINST THE SMUTWRITER PARTIES ARISING FROM, RELATED TO, OR IN CONNECTION WITH AI-GENERATED CONTENT, INCLUDING BUT NOT LIMITED TO CLAIMS BASED ON NEGLIGENCE, STRICT LIABILITY, PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY.

7. No Duty to Monitor; No Content Moderation

SmutWriter has no obligation and assumes no duty to:

  • Monitor, review, screen, filter, moderate, edit, or approve any content created through the Service
  • Investigate the legality of content generated by users or AI models
  • Remove or restrict access to content based on its nature or subject matter
  • Notify any person or authority about content created through the Service
  • Verify the accuracy, legality, or appropriateness of any AI output
  • Enforce compliance with laws or regulations applicable to user-generated content

SmutWriter may, but is not obligated to, take action against users or content that violates these Terms. The absence of enforcement action does not constitute approval, endorsement, or waiver of any rights.

8. Copyright, Intellectual Property, and DMCA

You acknowledge and agree that:

  • AI models generate output based on statistical patterns learned from training data, and such output may inadvertently resemble or reproduce elements of existing copyrighted works
  • SmutWriter does not guarantee that AI-generated content is original, non-infringing, or free from intellectual property claims
  • You are solely responsible for conducting any necessary clearance, due diligence, or review to ensure AI-generated content does not infringe on third-party rights
  • SmutWriter shall not be liable for any claims of copyright infringement, trademark infringement, misappropriation, or other intellectual property violations arising from content generated through the Service
  • Any use of real names, characters, brands, titles, or other identifiable elements in your prompts is at your sole risk and responsibility
  • You indemnify SmutWriter against all claims arising from alleged intellectual property infringement in content you create or distribute using the Service

SmutWriter respects intellectual property rights and will respond to valid DMCA takedown notices in accordance with the Digital Millennium Copyright Act. To submit a DMCA notice, contact support@smutwriter.com with the required statutory information.

9. Prohibited Uses

While SmutWriter provides an unrestricted creative writing environment, certain uses are strictly prohibited:

Absolutely Prohibited:

  • Creating, generating, or distributing any content depicting minors in sexual situations (CSAM). This is illegal and will result in immediate termination and reporting to authorities.
  • Creating content that promotes real-world violence against specific, identifiable individuals
  • Using the Service to harass, stalk, threaten, or defame real individuals
  • Using the Service to produce non-consensual intimate imagery of real persons

Additionally, you agree not to:

  • Use the Service for any illegal purpose or in violation of any applicable laws
  • Distribute content that infringes on third-party intellectual property rights
  • Attempt to reverse engineer, decompile, or extract the source code of the Service
  • Use automated systems or bots to access the Service in violation of usage limits
  • Share your account credentials with others or allow unauthorized access
  • Interfere with or disrupt the Service or its underlying infrastructure
  • Use the Service to generate spam, malware, or phishing content
  • Use the Service to generate content for the purpose of fraud, deception, or impersonation
  • Misrepresent AI-generated content as being written by a specific real person

IMPORTANT LIMITATION OF LIABILITY FOR PROHIBITED CONTENT:

While the above uses are prohibited and may result in account termination, SmutWriter acknowledges that it does not pre-screen, monitor, or filter content and therefore cannot prevent all prohibited uses. SmutWriter shall not be held liable for any prohibited content that is created through the Service, as SmutWriter does not exercise editorial control over AI outputs. The user who creates, prompts, directs, or distributes such content bears sole and exclusive legal responsibility.

10. International Use and Legal Compliance

The Service is operated from the United States. If you access the Service from outside the United States, you do so at your own risk and are solely responsible for compliance with all applicable local, national, and international laws.

  • Laws regarding adult content, obscenity, AI-generated material, and data privacy vary significantly by jurisdiction
  • Content that is legal in one jurisdiction may be illegal in another — you are solely responsible for understanding and complying with the laws applicable to you
  • SmutWriter makes no representation that the Service or any content generated through it is appropriate, legal, or available for use in any particular jurisdiction
  • SmutWriter shall not be liable for your failure to comply with any law or regulation applicable to your use of the Service in your jurisdiction
  • You agree not to access or use the Service from any jurisdiction where doing so would be illegal or where the content generated could violate applicable laws

11. Third-Party AI Providers and Services

SmutWriter utilizes third-party artificial intelligence models and services to generate content. You acknowledge and agree that:

  • SmutWriter does not own, develop, train, or control the underlying AI models used to generate content
  • The behavior, output, capabilities, and limitations of these AI models are determined by their respective providers and are subject to change without notice
  • SmutWriter is not responsible for the outputs, errors, biases, hallucinations, or failures of third-party AI models
  • Third-party AI providers may have their own terms of service, acceptable use policies, and content restrictions that apply independently
  • SmutWriter shall not be liable for any interruption, degradation, change, or discontinuation of third-party AI services
  • Your prompts and interactions may be processed by third-party AI providers subject to their respective privacy policies and data handling practices

12. Subscription and Payment

SmutWriter offers the following subscription options:

  • Free Tier: Free trial messages with basic features
  • Premium: Unlimited messages, advanced features, billed at $199.99/year ($16.67/month equivalent)

By subscribing to a paid plan:

  • You authorize SmutWriter to charge your payment method for the subscription fee
  • Subscriptions automatically renew unless cancelled before the renewal date
  • Payment is processed securely through Stripe
  • You are responsible for keeping your payment information current
  • Prices may change with notice; continued use constitutes acceptance of new pricing

13. No Refunds Policy

ALL SALES ARE FINAL. NO REFUNDS.

By subscribing to SmutWriter, you acknowledge and agree to the following:

  • All subscription fees are non-refundable
  • No refunds will be provided for unused portions of your subscription
  • No pro-rata refunds will be issued upon cancellation
  • Cancelling your subscription will stop future billing but will not result in a refund for the current billing period
  • No refunds will be issued for any reason, including dissatisfaction with the Service, technical issues, or account termination

You may cancel your subscription at any time through your account settings or by contacting support. Cancellation will take effect at the end of your current billing period, and you will retain access to premium features until that time.

By subscribing to SmutWriter, you expressly acknowledge that you have read, understood, and agree to this no-refunds policy.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

SMUTWRITER PARTIES EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT
  • ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, VIRUS-FREE, OR AVAILABLE AT ANY PARTICULAR TIME
  • ANY WARRANTY REGARDING THE QUALITY, ACCURACY, LEGALITY, RELIABILITY, ORIGINALITY, OR NON-INFRINGEMENT OF AI-GENERATED CONTENT
  • ANY WARRANTY THAT THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS, EXPECTATIONS, OR LEGAL OBLIGATIONS
  • ANY WARRANTY THAT AI-GENERATED CONTENT WILL NOT INFRINGE ON THIRD-PARTY INTELLECTUAL PROPERTY RIGHTS
  • ANY WARRANTY REGARDING THE LEGALITY OF CONTENT GENERATED IN YOUR JURISDICTION
  • ANY WARRANTY ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE

YOU USE THE SERVICE ENTIRELY AT YOUR OWN RISK AND DISCRETION. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM SMUTWRITER SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED HEREIN.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE SMUTWRITER PARTIES BE LIABLE TO YOU OR ANY THIRD PARTY FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND
  • ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES
  • ANY DAMAGES ARISING FROM CONTENT YOU OR ANY USER CREATES, GENERATES, PROMPTS, SHARES, PUBLISHES, OR DISTRIBUTES USING THE SERVICE
  • ANY DAMAGES ARISING FROM THIRD-PARTY CLAIMS RELATED TO YOUR CONTENT, INCLUDING BUT NOT LIMITED TO CLAIMS OF COPYRIGHT INFRINGEMENT, TRADEMARK INFRINGEMENT, DEFAMATION, INVASION OF PRIVACY, OR OBSCENITY
  • ANY DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE
  • ANY DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA
  • ANY DAMAGES ARISING FROM THE CONDUCT, CONTENT, OR ACTIONS OF ANY THIRD PARTY, INCLUDING OTHER USERS
  • ANY DAMAGES ARISING FROM ANY VIOLATION OF LAW COMMITTED BY YOU USING THE SERVICE
  • ANY DAMAGES ARISING FROM RELIANCE ON AI-GENERATED CONTENT

THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY (WHETHER CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, WARRANTY, OR OTHERWISE), EVEN IF SMUTWRITER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND EVEN IF A LIMITED REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

IN NO EVENT SHALL SMUTWRITER'S TOTAL AGGREGATE LIABILITY EXCEED THE LESSER OF (A) THE AMOUNT YOU ACTUALLY PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by applicable law.

16. Indemnification

You agree to indemnify, defend, and hold harmless the SmutWriter Parties from and against any and all claims, demands, actions, suits, proceedings, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees, court costs, and settlement amounts) arising from or related to:

  • Your use or misuse of the Service
  • Any and all content you create, generate, prompt, direct, publish, share, or distribute using the Service
  • Your violation of these Terms or any applicable law or regulation
  • Your violation of any third-party rights, including intellectual property rights, privacy rights, publicity rights, or any other proprietary rights
  • Any claim that your content caused damage to a third party, including claims of defamation, invasion of privacy, copyright infringement, trademark infringement, or obscenity
  • Any claim arising from your failure to comply with applicable laws in your jurisdiction
  • Any regulatory action, investigation, or proceeding arising from your content or use of the Service
  • Any criminal prosecution or investigation related to content you created using the Service

This indemnification obligation shall survive the termination of your account and these Terms.

17. Release of Claims

To the maximum extent permitted by applicable law, you hereby release and forever discharge the SmutWriter Parties from any and all claims, demands, damages, losses, and causes of action (whether known or unknown, suspected or unsuspected, disclosed or undisclosed) arising out of or in any way connected with:

  • The nature, content, legality, or effect of any AI-generated output
  • Any alleged similarity between AI-generated content and existing copyrighted works
  • Any legal consequences you experience as a result of content created using the Service
  • Any emotional distress, reputational harm, or other personal injury caused by AI-generated content
  • Any third-party claims directed at you arising from content generated through the Service

If you are a California resident, you expressly waive California Civil Code Section 1542, which provides: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You waive any similar provision in any other jurisdiction.

18. Our Intellectual Property and Third-Party Links

Your Content: You retain all ownership rights to the content you create using SmutWriter. We do not claim ownership of your stories or creative works.

Affiliate Disclosure: The Service may contain links to third-party products or services, including affiliate links. SmutWriter may receive a commission for purchases made through these links. This comes at no additional cost to you and helps support the maintenance and development of the Service. We only recommend products we believe add value to our community of writers.

Our Service: SmutWriter and its licensors retain all rights, title, and interest in and to the Service, including but not limited to:

  • The SmutWriter name, logo, and branding
  • The underlying technology, algorithms, and AI systems
  • The user interface, design, and functionality
  • All software, code, and documentation

You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

19. Termination

By You: You may cancel your subscription and stop using the Service at any time. No refunds will be provided (see Section 8).

By SmutWriter: We may suspend or terminate your access to the Service immediately, without prior notice or liability, if:

  • You violate these Terms
  • You engage in prohibited uses (see Section 6)
  • We are required to do so by law
  • We discontinue the Service

Upon termination, your right to use the Service will immediately cease. We may delete your account and associated data. No refunds will be provided for termination.

20. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.

21. Force Majeure

SmutWriter shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, civil unrest, government actions or regulations, embargoes, labor disputes, power failures, internet outages, third-party service provider failures (including AI model providers), cyberattacks, pandemics, or any other event beyond SmutWriter's reasonable control.

22. Changes to Terms

SmutWriter reserves the right to modify these Terms at any time. We will notify users of material changes by:

  • Updating the "Last Updated" date at the top of this page
  • Sending an email notification to registered users (for material changes)
  • Displaying a notice within the Service

Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.

23. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall be resolved through:

  1. Informal Resolution: First, by contacting us to attempt to resolve the dispute informally
  2. Binding Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration in Delaware, in accordance with the rules of the American Arbitration Association

You agree to waive any right to a jury trial or to participate in a class action lawsuit against SmutWriter.

24. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.

25. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SmutWriter regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
